What This Notice Covers

This COPPA Compliance Notice is published by NMG Express LLC, a Florida-registered limited liability company trading as Audio Imperial (EIN: 88-0909093; Registration No. L22000078949), with its registered business address at 4809 Laddie Ct, Orlando, Florida 32821, USA. This notice governs the website located at audioimperial.com and all associated pages, product listings, and checkout processes operated by NMG Express LLC.

The Children's Online Privacy Protection Act (COPPA), enacted under 15 U.S.C. §§ 6501–6506 and enforced through the Federal Trade Commission's Rule at 16 C.F.R. Part 312, requires that operators of websites directed to children under 13, or operators who have actual knowledge that they are collecting personal information from children under 13, obtain verifiable parental consent before collecting, using, or disclosing such information.

This notice describes Audio Imperial's current practices regarding children's privacy, who may use our website, what information we collect and from whom, and what rights parents and legal guardians hold under federal law.

This notice applies to all visitors to audioimperial.com, including prospective customers, registered account holders, and individuals who contact our support team.

Our Website Is Not Directed to Children

Age Restriction: This website is intended for users aged 18 years and older only.

audioimperial.com is a business-to-consumer retail website that sells premium hi-fi audio equipment including integrated amplifiers, digital-to-analog converters (DACs), network music streamers, loudspeakers, and turntables, with individual product prices ranging from approximately $400 to over $3,400 USD. These products are designed for, and marketed exclusively to, adult consumers who have an established interest in high-fidelity audio reproduction. Our website content, product descriptions, marketing language, and purchasing process are directed entirely at adults aged 18 and older.

Audio Imperial does not, and has never intended to, market, sell, or provide any product or service to children under 13 years of age. We do not collect, use, or disclose personal information from children under 13 knowingly or intentionally under any circumstances.

Adult-Priced Products

All products on audioimperial.com are priced between approximately $400 and $3,400. These price points are characteristic of enthusiast-grade consumer electronics purchased exclusively by adults making considered financial decisions.

Adult-Oriented Content

Our website content covers technical hi-fi specifications including amplifier wattage, digital-to-analog conversion, signal-to-noise ratios, and frequency response measurements. This content is written for knowledgeable adult audiophiles, not children.

Financial Transactions Only

Our checkout process requires entry of a valid payment method and billing address. Completing a purchase requires the purchaser to be a legal adult capable of entering into a binding commercial contract under U.S. law.

No Content for Children

Audio Imperial does not publish games, cartoons, animated characters, child-directed advertising, or any other content that would be appealing to or targeted at individuals under 13 years of age anywhere on our website.

Under the FTC's COPPA Rule (16 C.F.R. § 312.2), the determination of whether a website is "directed to children" is based on factors including the subject matter, visual content, music, use of animated characters, the age of models used in advertising, the nature of advertising on the website, and competent and reliable empirical evidence regarding the age of the website's audience. Evaluated against all of these criteria, audioimperial.com is unambiguously directed at adults and is not subject to the parental consent requirements that apply to child-directed sites.

Nevertheless, because COPPA also imposes obligations on operators who have actual knowledge that they are collecting personal information from a child under 13 — regardless of whether the site is child-directed — we have established the procedures described in this notice to address any situation where a child may attempt to use our website.

We Do Not Knowingly Collect Information from Children Under 13

Audio Imperial does not knowingly collect, request, use, store, or disclose any personal information from children under 13 years of age. We do not operate features specifically designed to attract children, we do not ask visitors to disclose their age as a condition of browsing (because our site is adult-directed), and we do not have a verified parental consent mechanism because our business model does not require or permit collection of data from minors.

If we discover that we have inadvertently collected personal information from a child under 13 without verifiable parental consent, we will take immediate steps to delete that information from our records entirely, without retention of any backup copies where technically feasible. We will not use that information for any purpose, including contact, marketing, or order fulfillment, prior to its deletion.

What constitutes "personal information" under COPPA includes: first and last name; home or physical address; email address; telephone number; Social Security number; persistent identifiers such as cookies or IP addresses when combined with other personal information; geolocation data sufficient to identify a street name and city; photographs, videos, or audio recordings that contain a child's image or voice; and any information collected from the child that could be combined with the above to identify a specific individual.

Our Procedure When We Discover a Child Has Provided Information

Immediate Account Suspension

As soon as we identify or receive notice that a user may be under 13, we immediately suspend access to any account associated with that individual and place a hold on any pending order or transaction.

No Use of Collected Information

We will not use, share, sell, or reference any personal information collected from the child for any purpose whatsoever during the period between discovery and deletion.

Parental or Guardian Notification

If we can identify a parent or legal guardian's contact information, we will attempt to notify them that information was received and of the steps we are taking. We will not use this notification as an opportunity to market to the family.

Permanent Data Deletion

We will permanently delete all personal information collected from the child from our active databases, CRM records, email marketing lists, order management system, and support ticket history within a commercially reasonable time, not to exceed 30 days of discovery.

Order Cancellation and Refund

Any order placed by a person later identified as being under 13 will be cancelled and any payment collected will be fully refunded to the original payment method. We will not process, fulfill, or ship any order where the account holder is a confirmed minor under 13.

This information is collected only from individuals who are, or who represent themselves to be, 18 years of age or older.

The data types listed above are collected only from adult customers who place orders, create accounts, or contact our support team. Audio Imperial does not build profiles on, track, or retain any data about persons under 13. If device or usage data is inadvertently associated with a visitor later identified as a child under 13, that data will be deleted in accordance with the deletion procedure described in Section 3 of this notice.

Third-Party Services Operating on This Website

Audio Imperial's website is built on Shopify's e-commerce platform and uses third-party services for payment processing, analytics, and operational functions. These third parties may automatically collect certain technical data from all website visitors, including device identifiers and IP addresses. This section discloses who those third parties are and what they collect.

COPPA and Third-Party Data Collection: Audio Imperial does not direct any third-party data collection services to target children under 13. None of our advertising or analytics activities are configured to serve targeted content to persons identified or inferred to be under 13 years of age. We do not permit any third-party advertising partner to collect personal information from our website for behavioral advertising purposes from users who are under 13.

Under 16 C.F.R. § 312.2, third-party services that act as "operators" under COPPA by collecting personal information from users of our website for their own purposes are independently responsible for COPPA compliance with respect to their own data collection activities. We select service providers who have publicly stated COPPA compliance commitments and whose platforms include age-based restrictions on data collection and advertising targeting.

Parents who wish to prevent third-party cookie or tracking data from being collected from their household's devices should use browser privacy controls, ad-blocking extensions, or a dedicated privacy browser. More information is available at the FTC's consumer resource site at consumer.ftc.gov.

Parental Rights and How to Exercise Them

Under COPPA (15 U.S.C. § 6502) and the FTC Rule (16 C.F.R. § 312.6), parents and legal guardians of children under 13 hold specific rights with respect to any personal information that has been collected about their child. While Audio Imperial does not intentionally collect any such information, these rights apply in any circumstance where information about a child has been collected inadvertently.

Right to Review

A parent or legal guardian may request a review of any personal information we have collected from their child under 13. Upon verification of the parent's identity and relationship to the child, we will provide a description of the categories of information held and, where technically feasible, the specific data collected.

Right to Correct

Parents may request correction of any inaccurate personal information about their child that we hold. We will promptly update or correct the information and confirm in writing when the correction has been made.

Right to Delete

Parents may demand permanent deletion of all personal information collected from their child. Upon verification, we will delete the information from our active systems within 14 business days and confirm deletion in writing. Where data has been shared with processors, we will instruct those processors to delete the data as well.

Right to Refuse Further Collection

Parents may refuse to permit further collection or use of their child's information at any time. We will immediately place a block on the child's identifier in our systems to prevent further collection, account activity, or marketing contact.

Right to Complain to the FTC

Parents who believe their rights under COPPA have been violated may file a complaint with the Federal Trade Commission at reportfraud.ftc.gov or by calling 1-877-FTC-HELP (1-877-382-4357). The FTC enforces COPPA and can impose civil penalties of up to $51,744 per violation.

Right to No Retaliation

Exercising any of the rights listed above will not result in any adverse consequence to the parent or to any adult member of the household who is a legitimate customer of Audio Imperial. We do not condition access to our products or services on a parent's waiver of any COPPA right.

How to Submit a Parental Request

To exercise any of the rights listed above, please contact us by email at support@audioimperial.com or by phone at +1 888-865-1086 during business hours (Monday–Friday, 9:00 AM–6:00 PM Eastern Standard Time). Please include in your request: (a) your full name as the parent or legal guardian; (b) the child's first name and approximate age; (c) any email address, username, or order number associated with the child; and (d) a description of the specific action you are requesting. We will respond to verified parental requests within 10 business days of receipt. We may request reasonable documentation to verify your identity and your relationship to the child before taking action.

Data Security Measures

The FTC's COPPA Rule and U.S. general data security standards require operators to maintain reasonable data security procedures for any personal information they hold. The following measures protect all personal data on audioimperial.com, including any data that may inadvertently involve a minor.

256-Bit SSL Encryption

All data transmitted between your browser and audioimperial.com is encrypted using industry-standard 256-bit SSL/TLS encryption. Our SSL certificate is active at all times and all HTTP requests are automatically redirected to HTTPS.

PCI DSS Level 1 Payment Processing

Payment card data is processed exclusively by Shopify Payments and its underlying processor (Stripe), both of which are certified to PCI DSS Level 1 standards — the highest level of payment card industry security certification. Audio Imperial servers never receive or store full card numbers.

Shopify Enterprise Security

Our store operates on Shopify's enterprise-grade hosted infrastructure, which includes SOC 2 Type II audited data centers, automated threat detection, DDoS protection, and regular penetration testing. Shopify maintains these security controls independently of our configuration.

Access Controls

Access to customer data within our Shopify admin dashboard is restricted to authorized personnel of NMG Express LLC on a need-to-know basis. We do not grant access to customer data to third parties other than our data processors listed in Section 5, and only to the extent necessary for them to perform their contracted service function.

Breach Notification

In the event of a data security breach that may involve personal information about a child under 13, we will promptly notify affected parents or guardians and comply with applicable state and federal breach notification laws, including the Florida Information Protection Act (Fla. Stat. § 501.171) and any applicable FTC guidance.

Data Minimization and Retention Limits

Audio Imperial collects only the personal information that is reasonably necessary to fulfill orders and operate our business. We do not collect more information than is needed, and we delete information when it is no longer required, in accordance with the retention periods described in Section 4 of this notice.

Cookies and Tracking Technologies

Audio Imperial's website uses cookies and similar tracking technologies as part of normal Shopify store operations and to support analytics and advertising functions. Cookies are small text files stored on your device by your browser when you visit a website. They enable functions such as remembering items in your shopping cart, keeping you logged into your account, and understanding which pages visitors view most often.

Because our website is not directed to children, we have not implemented specific child-directed cookie consent mechanisms beyond our standard site-wide cookie practices. However, we acknowledge that parents may wish to prevent any data collection from devices used by their children, and we address that below.

If a device in your household is used by a child under 13, you can take the following steps to limit automated data collection: (1) Enable private or incognito browsing mode when a child uses a device; (2) Block third-party cookies in your browser's privacy settings; (3) Use a browser extension designed to block advertising trackers; (4) Configure parental controls at the router or operating system level to restrict access to commercial websites; (5) Opt out of Google Analytics tracking at tools.google.com/dlpage/gaoptout; (6) Exercise your opt-out rights under the Digital Advertising Alliance's framework at optout.aboutads.info. Audio Imperial has no ability to retroactively delete cookie data held by third parties, but we encourage parents to use the opt-out tools provided directly by those third parties.

We Do Not Sell Children's Personal Information

Audio Imperial does not sell, rent, lease, license, or otherwise transfer personal information belonging to any child under 13 years of age to any third party under any circumstances. This prohibition is absolute and applies regardless of the consideration offered, the identity of the recipient, or the claimed purpose of the transfer.

More broadly, Audio Imperial does not sell the personal information of any customer — adult or minor — to third-party data brokers, list vendors, advertisers, or any other commercial entity for their independent commercial use. We share customer personal information only with the service providers listed in Section 5 of this notice, and only to the extent necessary to operate our store and fulfill your orders. Those service providers are contractually prohibited from using customer data for any purpose other than providing their contracted service to us.

For the avoidance of doubt: Audio Imperial does not operate a subscription service, does not use push notifications directed at children, does not collect children's location data, does not operate interactive features designed for children such as online games or competitions, and does not generate revenue through the monetization of children's data in any form.

The sale of children's personal information is prohibited under COPPA and is additionally restricted by the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), which prohibits the sale of personal information of consumers under 16 without opt-in consent, and of consumers under 13 without verifiable parental opt-in consent. While Audio Imperial's primary legal compliance framework is federal COPPA, we acknowledge these state-level protections and confirm our practices are consistent with them.

Changes to This COPPA Compliance Notice

Audio Imperial reserves the right to update or modify this COPPA Compliance Notice at any time to reflect changes in our data practices, applicable law, FTC guidance, or our business operations. When we make a material change to this notice, we will update the "Effective Date" and "Last Updated" date at the top and bottom of this page. We may also post a prominent notice on our homepage or send an email notification to registered account holders, depending on the significance of the change.

Changes to this notice become effective when they are posted to audioimperial.com. By continuing to use our website after the date an updated notice is posted, you acknowledge the terms of the revised notice. If you do not agree with a material change we have made, you should stop using our website and, if applicable, close your account.

We encourage parents and guardians to review this notice periodically to stay informed of how we are protecting children's privacy. If you have any questions about a change we have made or are planning to make, please contact us at support@audioimperial.com before the change takes effect.

Material Change

Any change to what personal information we collect, how we use it, who we share it with, or how parents can exercise their rights is considered a material change. We will update the effective date and notify registered account holders via email before a material change takes effect.

Corrections to grammar, formatting updates, clarifications that do not alter the substantive meaning of our practices, and URL updates are non-material changes. The effective date will be updated but no direct notification will be sent.

Law-Driven Change

If the FTC amends the COPPA Rule, if Congress enacts new federal children's privacy legislation, or if applicable Florida law changes in a way that affects this notice, we will update the notice to reflect those legal developments as promptly as practicable and will indicate the legal change that prompted the update.
