Limitation of Liability
& Disclaimers
A plain-language explanation of how warranty coverage, product safety, financing, shipping, and liability actually work when you buy hi-fi equipment from Audio Imperial — and which protections the law guarantees you regardless of anything below.
What This Page Covers
This page is long because hi-fi electronics involve real questions — warranty coverage, electrical safety, financing, and shipping — and we'd rather answer them clearly than bury them in fine print. Jump to any section below.
Please Read This Before You Buy
This isn't boilerplate copied from another store. It's written specifically for how Audio Imperial operates: a Florida-based reseller of authorized hi-fi electronics, shipping only within the United States.
NMG Express LLC ("NMG Express," "Audio Imperial," "we," "us," or "our") is the Florida limited liability company that owns and operates the e-commerce store at audioimperial.com (the "Site"). This Limitation of Liability & Disclaimers page supplements, and is incorporated into, our Terms of Service. It applies every time you browse the Site, place an order, contact our support team, use Site-integrated financing, or receive a shipment from one of our carriers.
We've tried to write this in plain English wherever the law lets us. You should understand exactly what we promise, what we don't promise, and what protections remain in place under federal and Florida consumer law no matter what this page says.
By using the Site or completing a purchase, you confirm that you've read and understood this page. If anything below ever conflicts with a right you're entitled to under non-waivable consumer protection law, that right controls — this page does not, and is not intended to, take it away.
“Nothing on this page exists to talk you out of a return, a warranty claim, or a refund you're owed. It exists so you know, in advance, exactly how liability and warranty coverage work for hi-fi electronics — before you place an order, not after.”

U.S. Consumer Protection Notice: NMG Express LLC operates Audio Imperial consistent with the FTC Act (15 U.S.C. § 45), the FTC's Mail, Internet, or Telephone Order Merchandise Rule (16 C.F.R. Part 435), and Florida's Deceptive and Unfair Trade Practices Act (Fla. Stat. ch. 501, Part II). Nothing on this page is written to misrepresent pricing, warranty coverage, or delivery timelines.
We Sell the Equipment. We Don't Build It.
Audio Imperial carries amplifiers & receivers, DACs, music streamers, speakers, and turntables, sourced as an authorized reseller of brands including Audiolab, Cyrus, Dual Electronics, Mission, Q Acoustics, and Violectric. Understanding where our responsibility starts and ends begins with understanding this distinction.
NMG Express LLC purchases inventory through each brand's official distribution channel and resells it to you, new and factory-sealed. We do not design, engineer, manufacture, or independently re-certify any amplifier, DAC, streamer, speaker, or turntable listed on the Site.
Technical specifications, safety certifications (such as UL listings or FCC equipment authorizations), and performance claims originate from the manufacturer, not from us. We publish that information in good faith and correct it whenever we learn it's wrong, but we cannot independently re-test every technical claim a manufacturer makes about its own product.
Because we only sell through authorized channels, every unit you buy through Audio Imperial is genuine, new, and eligible for the manufacturer's original warranty — grey-market or parallel-import units bought elsewhere may not carry the same protection.
We Try Hard to Be Accurate. Here's Where Reality Can Differ.
Specifications, photography, and pricing on the Site are maintained carefully, but a few categories of unavoidable variance are worth disclosing upfront.
Descriptions & Specifications
Product copy and technical specs are drawn from manufacturer literature. Manufacturers occasionally revise specs between production runs without notice, and we correct listed information as soon as we're made aware of a discrepancy.
Images & Color Accuracy
Product photography may differ slightly from the unit you receive due to lighting, finish batch variation, or your own screen's color calibration. Finish names (e.g., "Silver," "Black") refer to the manufacturer's official designation, not a guaranteed pixel-for-pixel match.
Pricing & Promotions
Prices are shown in U.S. Dollars and may change without notice. Applicable sales tax is calculated at checkout based on your shipping address. If a pricing error ever occurs, we will contact you before charging the corrected amount and you may cancel at no cost.
Stock & Availability
Inventory counts shown on the Site update in real time but are not a guarantee of availability until your order is confirmed and payment is processed. We reserve the right to limit quantities or discontinue any product at our discretion.
Your Warranty Comes From the Brand, Not From Us
Every new unit sold through Audio Imperial is eligible for the manufacturer's original warranty included with that specific product. We explain exactly how that works below, including the federal law that governs it.
Coverage length, what's included, and how to file a claim differ by brand and by product line — an Audiolab amplifier, a Dual Electronics turntable, and a Violectric headphone amp may each carry different warranty terms. The specific coverage for the unit you purchase is included in the manufacturer's documentation that ships inside the box, and is also summarized on the relevant product page wherever the manufacturer makes that information available to us.
NMG Express LLC is not the warrantor. We did not issue, and do not independently extend, the manufacturer's warranty. Our role is to help you exercise it: if you ever have trouble determining who to contact for a warranty claim, email support@audioimperial.com with your order number and we will point you to the correct manufacturer service channel or assist directly where we are able to.
Damage that occurs in transit, before the product reaches you, is handled through our own Return & Refund Policy rather than the manufacturer's warranty, since that is a shipping issue, not a product defect.
Magnuson-Moss Warranty Act Notice (15 U.S.C. § 2301 et seq.): Federal law requires that any written consumer product warranty be clearly labeled either "Full" or "Limited." A Limited Warranty may restrict the duration of certain implied warranties but cannot eliminate them in states that don't allow that. The manufacturer — not NMG Express LLC — is the warrantor responsible for honoring these terms, and its written warranty documentation governs over any summary we provide.
Implied Warranty Floor: Regardless of any manufacturer warranty's stated length, Florida's implied warranty of merchantability (Fla. Stat. § 672.314) and implied warranty of fitness for a particular purpose (Fla. Stat. § 672.315) apply to consumer goods sold in Florida to the extent state law requires, and are not eliminated by this page.
The "As Is" Language, Explained Honestly
Our Terms of Service contain standard "as is" language required for an online store. Here is what that actually means in practice, and what it does not take away from you.
EXCEPT FOR ANY MANUFACTURER WARRANTY THAT EXPRESSLY ACCOMPANIES A PRODUCT, AND EXCEPT WHERE PROHIBITED BY LAW, PRODUCTS, CONTENT, AND THE SITE ITSELF ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. NMG EXPRESS LLC MAKES NO INDEPENDENT WARRANTY OF ITS OWN, EXPRESS OR IMPLIED, BEYOND WHAT THE ORIGINAL MANUFACTURER PROVIDES WITH THE PRODUCT.
This does not override your statutory rights. Florida and federal law do not allow certain implied warranties on consumer goods — such as the implied warranty of merchantability under Fla. Stat. § 672.314 — to be fully eliminated. Where the law does not permit a full disclaimer, this section applies only to the extent the law actually allows, and any non-waivable right you have remains fully in effect.
These Products Are Built for U.S. Power Systems
Because we ship exclusively within the United States, every product we sell is configured for the U.S. electrical standard. A few safety points are worth stating plainly.
120V / 60Hz Standard Only
All amplifiers, DACs, streamers, and powered components sold by Audio Imperial are configured for North American 120-volt, 60Hz electrical service and standard NEMA outlets. They are not intended for use with step-up/step-down voltage converters or outside the U.S. without the manufacturer's explicit guidance.
Wiring & Grounding
Speaker wire gauge, impedance matching, and AC circuit loading affect both performance and safety. For higher-power amplifiers or multi-room setups, we recommend a dedicated, properly grounded circuit installed or verified by a licensed electrician.
FCC Part 15 Devices
Music streamers and Bluetooth-enabled components carry FCC equipment authorization under 47 C.F.R. Part 15, issued by the manufacturer. Operate these devices according to the included manual; unauthorized modification can void both that authorization and your warranty.
Misuse Voids Coverage
Operating a product outside its rated voltage, modifying its wiring, or bypassing its enclosure falls outside both manufacturer warranty coverage and our own return eligibility. Always follow the safety instructions printed in the product's included manual.
High-Fidelity Sound Can Mean High Volume. Use It Responsibly.
The amplifiers and speakers sold through Audio Imperial are capable of producing sound pressure levels that can cause permanent hearing damage with prolonged exposure. The CDC and the National Institute for Occupational Safety and Health note that sustained exposure above roughly 85 decibels — a level many home hi-fi systems can exceed at moderate-to-high volume — can damage hearing over time.
We have no control over how you configure, position, or operate the equipment you purchase. You are solely responsible for setting safe listening volumes for yourself, your household, and anyone else — including children — who may be exposed to your system. If you experience ringing in your ears, muffled hearing, or discomfort after listening, lower the volume and consult a healthcare professional.
We Sell the Gear. Setup Is in Your Hands — or a Pro's.
Audio Imperial does not provide in-home installation or setup services. Some categories of equipment benefit from extra care during setup, so here's what to know.
Turntables & Cartridge Alignment
Tonearm balance and cartridge alignment affect both sound quality and stylus/record wear. Follow the included manual carefully, or have a qualified technician handle alignment. Setup errors performed by the customer are outside our return and warranty coverage.
Whole-Home & Multi-Room Systems
If you're planning an in-wall, multi-room, or whole-home setup spanning multiple amplifiers or speaker zones, we recommend a licensed audio/electrical installer. We're glad to help you choose compatible components, but on-site installation falls outside what we provide.
We're Still Here to Help
While we don't install systems in person, our support team can walk you through manufacturer setup guides, cable/impedance compatibility questions, and basic troubleshooting by phone, email, or live chat during business hours.
Financing Is Offered by a Third Party, Not by Us
High-end audio is a real investment, and we offer financing at checkout to help — but it's important to know exactly who you're entering an agreement with.
Shop Pay Installments
Financing displayed at checkout is offered through Shop Pay Installments and its lending partners, subject to credit approval. The installment agreement is between you and the financing provider, not NMG Express LLC. APR, fees, and repayment terms are disclosed by the lender in accordance with the Truth in Lending Act (Regulation Z).
Card & Digital Wallet Processing
Visa, Mastercard, American Express, Discover, PayPal, Venmo, Apple Pay, and Google Pay are processed through Shopify's PCI DSS-compliant payment infrastructure. We do not store your full card number on our own servers at any point.
Billing Disputes
Disputes with your bank or financing provider over a charge are governed by that provider's own agreement and, where applicable, the Truth in Lending Act or the Electronic Fund Transfer Act. Please contact support@audioimperial.com first — most order-level issues can be resolved directly with us faster than through a chargeback.
How Liability Works Once a Package Leaves Our Hands
Audio Imperial ships within the United States only, using UPS, FedEx, USPS, or freight carriers depending on a product's size and weight, as detailed in our Shipping Policy. Estimated delivery windows are good-faith estimates, not guarantees — carrier delays, weather, and customs-adjacent processing for products with international components are outside our control.
Title and risk of loss pass to you once a product is handed off to the carrier, except where damage is reported and verified under our Refund Policy's damaged-item process, in which case we handle it at no cost to you.
Larger or heavier products — certain amplifiers, floorstanding speakers, and turntable consoles — may ship via freight and require a scheduled delivery appointment and signature. Please inspect freight deliveries before signing whenever the carrier allows it.
FTC Mail, Internet, or Telephone Order Rule (16 C.F.R. Part 435): We ship within the timeframes stated at checkout and in our Shipping Policy. If we cannot ship within that window, we will notify you and offer the choice of a revised ship date, a refund, or a substitute item, consistent with this federal rule.
Sales Tax: Applicable state and local sales tax is calculated and applied at checkout based on your shipping address, in accordance with the destination state's tax laws.
This Page Doesn't Change Your Return Rights — the Refund Policy Does That
Return eligibility windows, restocking fees, exchange procedures, and damaged-item handling are governed exclusively by our dedicated Refund Policy. We link to it here rather than duplicate it, so there's only ever one accurate version.
Links Off Our Site Are Outside Our Control
The Site may link to manufacturer pages, instructional videos, or third-party reviews for your convenience. We don't control, and aren't responsible for, the content, accuracy, or availability of any site we don't operate. Visiting a linked site is at your own discretion, and that site's own terms and privacy practices govern your use of it.
The Core Legal Limit, in One Place
This is the central clause this page is named for. We've kept the boilerplate emphasis required for it to be enforceable, paired with a plain-language explanation and a clear carve-out for rights that can't legally be limited.
TO THE FULLEST EXTENT PERMITTED BY LAW, NMG EXPRESS LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR PROPERTY DAMAGE NOT CAUSED BY OUR OWN NEGLIGENCE — ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED THROUGH IT.
WHERE LIABILITY CANNOT BE FULLY EXCLUDED UNDER APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO A SPECIFIC PRODUCT OR ORDER IS LIMITED TO THE AMOUNT YOU ACTUALLY PAID FOR THAT PRODUCT.
What this does not limit: This section does not apply to, and does not attempt to limit, liability that cannot lawfully be limited under Florida or federal law — including our own gross negligence or willful misconduct, or bodily injury caused by a defective product to the extent required by Florida product-liability law (Fla. Stat. § 768.81 and related case law). In plain terms: if we genuinely did something seriously wrong, this clause does not protect us from accountability for it.
Two Standard Protections, Explained
Indemnification
As set out in Section 18 of our Terms of Service, if your misuse of the Site, violation of our Terms, or violation of someone else's rights leads to a third-party claim against us, you agree to cover the resulting losses and reasonable attorneys' fees. This is a standard protection and does not apply to claims arising from our own breach or negligence.
Force Majeure
We are not responsible for delays or failures caused by events reasonably beyond our control — carrier network disruptions, severe weather, labor disputes, manufacturer supply shortages, or government action. We will communicate with you promptly if such an event affects your order.
The Closing Legal Details
Governing Law: This page and the Terms of Service it supplements are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law principles. You and NMG Express LLC consent to the jurisdiction of the state and federal courts located in Florida for any dispute that isn't resolved informally.
Resolving an Issue First: Before pursuing a formal claim, please contact support@audioimperial.com or call +1 888-865-1086. The overwhelming majority of order, warranty, and shipping concerns are resolved directly without needing to escalate further.
Severability: If any part of this page is found unenforceable, the rest remains in full effect, and the unenforceable part will be applied to the maximum extent the law allows.
Survival: The Disclaimer of Warranties, Limitation of Liability, and Indemnification sections remain in effect even after your relationship with the Site ends.
Changes to This Page: We may update this page as our product line, financing partners, or shipping carriers change. The "Effective / Last Updated" date in Section 02 always reflects the current version. Continued use of the Site after an update means you accept the revised page.
