This addendum explains how Audio Imperial's policies apply specifically to customers who shop with us or have orders shipped to a California address, in addition to the rights already described in our core store policies.
This Addendum Supplements — It Does Not Replace — Our Core Policies
Audio Imperial is a Florida-based retailer, operated by NMG Express LLC, that ships hi-fi audio equipment to all 50 U.S. states, including California. Our Privacy Policy, Refund Policy, Shipping Policy, and Terms of Service apply to every customer, regardless of location.
This page exists because California has enacted several consumer protection, privacy, and product-disclosure statutes that are more specific or more protective than general U.S. federal law. Where one of those California statutes applies to your purchase, this addendum explains exactly how it works in practice on our store — in plain language, without legal guesswork.
If you are shopping from California, or having an order delivered to a California address, this page is written for you. If any statement here ever appears to conflict with a general statement made elsewhere on our site, the California-specific explanation on this page controls for California residents, and only for the specific point it addresses.
Your Return Rights Under California Civil Code §1723
California law requires any retailer whose refund policy is not "full cash refund, or credit, with no time limit" to conspicuously disclose its actual policy to shoppers before purchase. Audio Imperial's refund policy is described in full below, and applies identically whether you live in California or anywhere else in the United States.
30-Day Return Window
Returns must be reported within 30 days of delivery. Items must be unused, undamaged, and in original packaging with all accessories included.
15% Restocking Fee
Change-of-mind returns carry a restocking fee of up to 15% of the item price. This fee never applies to items that arrive damaged or defective.
Customer-Paid Return Shipping
Return shipping is paid by the customer unless the item arrived damaged, defective, or was shipped to you in error — in which case we cover it.
Always Conspicuously Posted
This policy is permanently published on our Refund Policy page and is visible to every shopper before checkout is completed — satisfying California's disclosure requirement.
Civil Code §1723 Statement: Because our policy includes a restocking fee and a 30-day window rather than an unconditional full refund, California law requires us to display it conspicuously, which we do here and on our Refund Policy page. No California customer receives different or lesser return terms than any other U.S. customer.
Your Rights Under the CCPA and CPRA
The California Consumer Privacy Act, as amended by the California Privacy Rights Act (Cal. Civ. Code §1798.100 et seq.), gives California residents specific, enforceable rights over the personal information collected through audioimperial.com. These rights apply in addition to everything already described in our Privacy Policy.
Right to Know
Request the categories and specific pieces of personal information we have collected about you, and the sources, purposes, and third parties involved.
Right to Delete
Request deletion of personal information we have collected from you, subject to limited exceptions required to fulfill orders or comply with law.
Right to Correct
Request that we correct inaccurate personal information we maintain about you, such as an outdated address or contact detail.
Right to Opt Out of Sale / Sharing
Direct us not to "sell" or "share" your personal information, including for cross-context behavioral advertising, at any time.
Right to Limit Sensitive PI
Limit our use of sensitive personal information (such as precise geolocation or financial account details) to what is necessary to provide the Services.
Right to Non-Discrimination
You will never receive a different price, different service quality, or be denied access to products for exercising any of these rights.
Right to Appeal
If we decline a request, you may ask us to reconsider that decision by replying to our response with your reason for appeal.
Authorized Agent Requests
You may designate an authorized agent to submit a request on your behalf, provided we can verify both your identity and the agent's authorization.
Do We Sell or Share Your Information?
Audio Imperial does not sell personal information in exchange for money. Like most online retailers, we use advertising and analytics partners (described in our Privacy Policy) that may, under the CPRA's broad definition, be considered "sharing" personal information for cross-context behavioral advertising. You can direct us to stop this at any time using the contact details below — with no need to create an account or pay any fee.
We do not knowingly sell or share the personal information of consumers we know to be under 16 years of age.
California's "Shine the Light" Law
Under Cal. Civ. Code §1798.83, California residents may request, once per calendar year and free of charge, a list of any personal information we disclosed to third parties for those third parties' own direct marketing purposes during the prior calendar year. Audio Imperial does not disclose personal information to unaffiliated third parties for their own direct marketing use without your consent; if you would like written confirmation of this, contact us using the details at the bottom of this page.

California-Specific Product Disclosures
Electronics retailers selling into California are subject to a handful of product-disclosure statutes that do not exist at the federal level. Here is exactly how each one applies to the amplifiers, DACs, speakers, streamers, and turntables we sell.
Proposition 65 Warnings
Some electronic components — such as soldered circuit boards or internal wiring — can contain trace amounts of chemicals listed under California's Safe Drinking Water and Toxic Enforcement Act. Where a manufacturer's compliance documentation indicates a Proposition 65 warning is required for a specific product, that warning is displayed on the relevant product page or included in the product packaging. If you don't see a required warning on a listing, contact us before ordering and we'll confirm based on the manufacturer's data.
Health & Safety Code §25249.5 et seq.Electronic Waste & Recycling
California's Electronic Waste Recycling Act applies primarily to video display devices, like TVs and computer monitors. The amplifiers, DACs, music streamers, loudspeakers, and turntables sold by Audio Imperial fall outside that definition, so no California e-waste recycling fee is added at checkout. We still encourage every customer to recycle electronics responsibly through a certified e-waste recycler or a CalRecycle drop-off point rather than household trash, especially for products containing rechargeable batteries.
Pub. Resources Code §42463 et seq."Made in USA" Claims
California's domestic-origin labeling law is stricter than the federal standard. Audio Imperial does not advertise or label any product as "Made in USA." Our catalog features internationally recognized hi-fi brands — including Audiolab, Cyrus, Mission, and Q Acoustics from the United Kingdom, and Dual Electronics and Violectric from Germany — and accurate country-of-origin information, where available, appears on individual product pages.
Bus. & Prof. Code §17533.7How Your California Order Is Taxed and Financed
Two areas of California law — sales tax sourcing and automatic-renewal disclosure — directly affect how an order is priced and billed. Here is exactly how each works for orders shipped to California.
California Sales & Use Tax
We collect California state and local district sales and use tax on every order shipped to a California address, calculated automatically at checkout from the destination ZIP code in line with California Department of Tax and Fee Administration sourcing rules. California's statewide base rate is 7.25% — the highest base rate of any U.S. state — and combined with local district add-ons, your total rate may reach roughly 10.75% depending on your city or county. The exact amount is itemized before you place your order; nothing is added afterward.
No Subscriptions or Auto-Renewal
Audio Imperial does not offer subscriptions, membership plans, free-trial-to-paid conversions, or any other automatically renewing product or service. Every order is a single, one-time transaction with the total price disclosed in full before you submit payment. If that ever changes, California customers will receive the affirmative-consent disclosures, easy-cancellation method, and renewal reminders required before any such offer is presented.
Financing Through Shop Pay Installments
Eligible orders may qualify for installment financing through Shop Pay Installments at checkout, which is powered and serviced by Affirm, Inc. — an independent lender, not Audio Imperial. All credit terms and approval decisions come directly from Affirm. For California residents, Affirm Loan Services, LLC is licensed under the California Financing Law. Questions about a financing application or repayment should go directly to Affirm, not to Audio Imperial.
Manufacturer Warranties Under the Song-Beverly Act
Every product Audio Imperial sells is sourced through authorized brand channels and ships with the manufacturer's full original warranty. California's Song-Beverly Consumer Warranty Act (Cal. Civ. Code §1790 et seq.) provides an implied warranty of merchantability for consumer goods sold in California, and a seller cannot waive or shorten that implied warranty below the duration of any express written warranty offered with the product.
Our general Terms of Service contains broad "as is" and warranty-disclaimer language that applies under ordinary contract principles in most states. For California residents purchasing a product that includes a manufacturer's express written warranty, that disclaimer language is limited to the extent required by the Song-Beverly Act — it does not reduce, waive, or shorten any implied warranty of merchantability that California law makes non-waivable for the length of the express warranty period.
If you are a California resident, nothing in our Terms of Service reduces your implied warranty rights under the Song-Beverly Consumer Warranty Act below what the manufacturer's express warranty already provides.
Resolving Disputes and Accessing Our Store
Consumers Legal Remedies Act
California's Consumers Legal Remedies Act (Cal. Civ. Code §1750 et seq.) prohibits unfair or deceptive practices in the sale of consumer goods and gives California residents specific remedies if those rules are violated. Before pursuing any formal claim under the CLRA, we ask that you first contact our support team directly — the vast majority of order issues are resolved quickly through a refund, replacement, or correction once we hear from you.

We want every customer, including those covered by the Unruh Civil Rights Act, to be able to browse and purchase from audioimperial.com without barriers.
