DMCA Takedown
Policy
How Audio Imperial responds to copyright concerns about content on this website, how to submit a takedown notice, and how to submit a counter-notice if your content was removed in error.
Audio Imperial (audioimperial.com) is operated by NMG Express LLC, a registered Florida limited liability company (Registration No. L22000078949, EIN 88-0909093), with its registered office at 4809 Laddie Ct, Orlando, Florida 32821, USA. We are a hi-fi audio equipment retailer selling amplifiers, DACs, music streamers, speakers, and turntables, and we respect the intellectual property rights of others.
This policy explains how we handle claims of copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, with respect to content that appears on audioimperial.com. This includes our own original content—such as product photography, written descriptions, and page design—as well as the limited customer-submitted content our website accepts, such as written product reviews.

Our Approach to Content & Intellectual Property
Transparency about how our website's content is sourced makes it easier to understand what a legitimate copyright concern about this site would actually look like.
The product photography, specifications, and descriptive text for the items we sell are provided to us by, or used with the authorization of, the brands we are an authorized dealer for: Audiolab, Cyrus, Dual Electronics, Mission, Q Acoustics, and Violectric. Original page layouts, written guides, and policy pages on audioimperial.com are created by us. We do not knowingly use third-party copyrighted material—photography, text, video, or otherwise—without authorization.
The only content area on our website where a customer submits their own material is our product review feature, where customers may leave written reviews of products they have purchased. We do not currently accept customer-submitted photos, videos, or other media through this feature. If that changes in the future, this policy will be updated accordingly.
What This Policy Covers
This policy applies to any claim that material appearing on audioimperial.com infringes a copyright you own or are authorized to enforce.
Product Photography
If you believe an image on our site infringes your copyright, including product or lifestyle photography, this policy applies.
Written Content
Product descriptions, guides, blog-style content, or any other original text published on our pages.
Customer Reviews
Written reviews submitted by customers through our product review feature, if you believe a review reproduces your copyrighted text.
Video or Multimedia
Any video, audio, or other media we may publish directly on our pages, should such content be added in the future.
Page Design Elements
Original layout, graphics, or design elements on our site you believe were copied from your copyrighted work.
What This Does Not Cover
Trademark concerns (see Section 09), general product or pricing disputes, and order or customer service issues are handled under our other policies, not this one.
How to File a DMCA Takedown Notice
If you believe content on audioimperial.com infringes a copyright you own, you may submit a written takedown notice to our designated contact below.
Before filing, consider whether the use might be authorized by the copyright owner, by law (including fair use), or by a licensing agreement. The DMCA requires a good-faith belief that the use is not authorized, and knowingly misrepresenting a claim can carry legal consequences (see Section 08).
Your notice must include every element listed in Section 04 below. Incomplete notices may delay or prevent action, since we cannot evaluate a claim we cannot fully understand or verify.
Email your written notice to support@audioimperial.com with the subject line “DMCA Takedown Notice,” or mail it to NMG Express LLC, 4809 Laddie Ct, Orlando, Florida 32821, USA, Attn: DMCA Agent.
We review every notice we receive. If the notice is complete and identifies a genuine concern, we act expeditiously to remove or disable access to the identified material, consistent with our obligations described in Section 05.
Required Elements of a Valid Notice
To be effective under 17 U.S.C. § 512(c)(3)(A), your written notice must include the following elements.
A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
Identification of the copyrighted work claimed to have been infringed, or, if multiple works at our site are covered by a single notification, a representative list of those works.
Identification of the material claimed to be infringing, with enough specific information (such as the exact page URL) to allow us to locate it on audioimperial.com.
Your contact information, including an address, telephone number, and email address, so we can reach you about the notice.
A statement of good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement, made under penalty of perjury, that the information in the notice is accurate, and that you are the copyright owner or are authorized to act on the owner's behalf.
Note: We cannot act on a notice that is missing required elements. If your notice is incomplete, we will let you know what is missing so you can resubmit it, but the clock on our response does not begin until we have a complete, valid notice.
What Happens After We Receive a Notice
Here is the exact process we follow once we receive a complete and valid takedown notice.
We confirm the notice contains every element described in Section 04. If anything is missing, we contact the sender to request the missing information before taking action.
Once we have a complete notice and have located the material identified, we act expeditiously to remove or disable access to it, consistent with our obligations under 17 U.S.C. § 512.
If the material in question was submitted by a customer (for example, through our product review feature), we take reasonable steps to notify that person that their content was removed and why, and provide them with a copy of the takedown notice.
We keep a record of the notice, the material removed, and the date of removal, consistent with our recordkeeping obligations and our repeat infringer policy described in Section 07.
Filing a Counter-Notice
If your content (for example, a product review) was removed because of a takedown notice and you believe it was removed in error or as a result of misidentification, you may submit a written counter-notice.
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which Audio Imperial may be found), and that you will accept service of process from the person who submitted the original takedown notice.
Send your counter-notice to support@audioimperial.com with the subject line “DMCA Counter-Notice,” or by mail to NMG Express LLC, 4809 Laddie Ct, Orlando, Florida 32821, USA, Attn: DMCA Agent.
Upon receipt of a valid counter-notice, we will forward a copy to the original complaining party. If that party does not notify us that they have filed a court action seeking to restrain the allegedly infringing activity within ten business days, we may restore the removed material between ten and fourteen business days after receiving your counter-notice, as provided under 17 U.S.C. § 512(g).
Repeat Infringer Policy
Audio Imperial maintains a policy of terminating, in appropriate circumstances, the ability of customers to submit content (such as product reviews) to our website if they are determined to be repeat infringers. We track valid takedown notices received against content submitted by a given customer account, and a pattern of confirmed, uncontested infringement may result in suspension of that customer's ability to submit reviews or other content to our site, independent of any other aspect of their account or ability to purchase products from us.
False Claims & Misrepresentation
Before submitting a takedown notice or counter-notice, please consider carefully whether the material is actually infringing. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees, incurred as a result of that misrepresentation. We take false or bad-faith claims seriously and reserve the right to disregard notices that appear to be submitted for an improper purpose, such as suppressing a negative but lawful customer review.
Trademarks & Brand Names
This policy addresses copyright specifically. Trademark concerns work differently and are addressed here for clarity.
The brand names, logos, and trademarks of Audiolab, Cyrus, Dual Electronics, Mission, Q Acoustics, Violectric, and any other manufacturer referenced on audioimperial.com are the property of their respective owners. We use these names and marks to accurately identify the genuine, authorized products we sell, which is a permitted nominative use under U.S. trademark law and does not require a separate license. If you are a brand owner with a concern about how your trademark is displayed or used on our site, please contact us at support@audioimperial.com and we will address it directly; trademark concerns are handled outside the formal DMCA notice process described above, since the DMCA's notice-and-takedown system under 17 U.S.C. § 512 applies to copyright, not trademark, claims.
