Audio Imperial — Privacy & Data Protection

Privacy Policy

This policy explains, in plain English, what personal information Audio Imperial collects from you, why we collect it, who we share it with, and the choices and rights you have — including how to opt out.

1. Who We Are

Audio Imperial is an online retailer of premium hi-fi audio equipment — amplifiers and receivers, DACs, music streamers, speakers, and turntables — sold exclusively to customers shipping within the United States. Audio Imperial is operated by NMG Express LLC, a limited liability company registered in the State of Florida (Registration No. L22000078949, EIN 88-0909093), with a registered address at 4809 Laddie Ct, Orlando, FL 32821, USA.

When this policy refers to “Audio Imperial,” “we,” “us,” or “our,” it means NMG Express LLC operating the storefront at audioimperial.com. For the purposes of U.S. privacy law, NMG Express LLC is the “business” or “controller” responsible for the personal information described in this policy.

2. Scope of This Policy

This Privacy Policy applies to personal information we collect through audioimperial.com, through phone or email correspondence with our support team, and through any order you place with us. It does not apply to the practices of companies we do not own or control, including the carriers that deliver your order or any third-party site you may reach by following a link from our store.

Audio Imperial ships only to addresses within the 50 United States. We do not sell internationally and do not knowingly collect personal information from individuals located outside the United States. If you access our site from outside the U.S., please be aware your information will be transferred to and processed in the United States.

3. Information We Collect

We collect only the information reasonably necessary to sell and ship audio equipment to you, process payment securely, support you after the sale, and operate our store responsibly. The categories below reflect what we actually collect — nothing more.

Contact & Identity Information Full name, shipping address, billing address, email address, and phone number — collected when you place an order, create an account, contact support, or sign up for marketing emails or SMS.
Order & Transaction Information Products purchased, order value, order date, shipping method, financing selection (if used), warranty registrations, and any notes or correspondence related to your order, return, or cancellation request.
Payment Information We do not directly receive or store your full card number, CVV, or bank account credentials. Payment details are entered directly into our payment processor's secure, PCI-DSS-compliant checkout (Shopify Payments and/or the card networks and processors it integrates with) and tokenized there. We retain only the last four digits of a payment card and the transaction status needed to confirm and reconcile your order.
Device & Usage Information IP address, browser type and version, device type, operating system, referring/exit pages, pages viewed, time spent on pages, and approximate location derived from your IP address. This is collected automatically through cookies and similar technologies described in Section 5.
Communications You Send Us Any information you choose to share when emailing, calling, or chatting with our support team, including the content of those messages and any attachments you provide (such as a photo of a defective unit for a warranty claim).

We do not knowingly collect: government-issued ID numbers (other than the last four digits of payment cards retained for order reconciliation), precise real-time GPS location, biometric data, health data, or any information from anyone we know to be under the age of 18 (see Section 11).

4. How We Collect Your Information

Directly From You When you place an order, create an account, subscribe to emails or SMS, contact support, request a return or cancellation, or fill out the Privacy Opt-Out Request Form.
Automatically Through cookies, pixels, and similar technologies as you browse audioimperial.com (see Section 5).
From Third Parties From our e-commerce platform (Shopify), payment processor, shipping carriers confirming delivery status, and — if you used one — a financing provider confirming approval status for a financed purchase.

5. Cookies & Tracking Technologies

Like virtually every online store, audioimperial.com uses cookies and similar technologies (such as pixels and local storage) to make the site function, remember your cart, and understand how shoppers use our store. We group these into three categories:

Necessary Cookies

Required for the store to work — keeping items in your cart, remembering your session, and completing secure checkout through our platform, Shopify Inc. These cannot be switched off because the site will not function correctly without them.

Analytics Cookies

Where enabled, we use analytics services such as Google Analytics and Shopify's built-in analytics to understand which pages and products customers view, how they arrived at our store, and how the site performs, so we can fix problems and improve the shopping experience.

Advertising & Remarketing Cookies

Where enabled, advertising partners such as Google Ads and Meta (Facebook/Instagram) may place a pixel or cookie on our site so we can show you relevant ads for products you viewed, on their platforms. This use is treated as a “sale” or “sharing” of personal information under certain state privacy laws, and you can opt out of it at any time — see Section 7.

You can control cookies through your browser settings, including blocking or deleting them. Doing so may affect features such as your cart contents persisting between visits. We also automatically honor the Global Privacy Control (GPC) browser signal as a valid opt-out-of-sale/sharing request where legally required.

6. How We Use Your Information

We use the information described above only for clear, specific purposes connected to running our store and serving our customers:

  • To process, fulfill, and ship your order, including coordinating with the carrier and confirming delivery.
  • To process payment securely and prevent fraudulent transactions.
  • To communicate with you about your order, including confirmations, shipping updates, and responses to support requests, cancellations, or returns.
  • To register and honor manufacturer warranties on the products you purchase.
  • To process financing applications you voluntarily choose to use at checkout, in partnership with our financing provider.
  • To send marketing emails or SMS messages, only if you have opted in, and to let you opt out at any time.
  • To analyze site traffic and shopping behavior so we can improve product selection, site performance, and the overall shopping experience.
  • To show relevant advertising on third-party platforms, where you have not opted out of this use.
  • To detect, investigate, and prevent fraud, abuse, or activity that violates our Terms of Service.
  • To comply with tax, accounting, consumer-protection, and other legal obligations applicable to a Florida-registered retailer.

We do not use your information for any purpose that is unrelated to, or incompatible with, the purposes listed above without notifying you and, where required by law, obtaining your consent first.

7. Who We Share Your Information With

Audio Imperial does not sell your personal information for cash. We share specific, limited categories of information with the following types of companies, only as needed to run our store:

Who Why
E-Commerce Platform (Shopify Inc.) Hosts our store, processes checkout, and stores order records securely on our behalf.
Payment Processors Securely authorize and process your payment (e.g. Shopify Payments and the underlying card networks/processors it uses).
Shipping Carriers Deliver your order and provide tracking updates (e.g. UPS, FedEx, USPS, or other national carriers we use for U.S. shipments).
Financing Partner If you choose financing at checkout, your application details are shared with our financing partner, subject to their own privacy practices and credit approval process.
Analytics & Advertising Partners Services such as Google Analytics, Google Ads, and Meta receive limited device/usage data to help us understand site performance and, where you have not opted out, show relevant ads.
Brand Manufacturers If you register a product warranty, limited order details may be shared with the relevant brand (e.g. Audiolab, Cyrus, Dual Electronics, Mission, Q Acoustics, Violectric) to activate manufacturer warranty coverage.
Legal & Safety Where required to comply with a subpoena, court order, or other legal process, or to protect the rights, property, or safety of Audio Imperial, our customers, or the public.

We do not share your personal information with third parties for their own independent marketing purposes without your consent, and we have never sold personal information to a data broker.

Your Right to Opt Out: Sharing data with our analytics and advertising partners for targeted advertising may be defined as a “sale” or “sharing” of personal information under certain U.S. state laws. You can opt out of this at any time, at no cost, with no effect on your ability to shop with us, by submitting our Privacy Opt-Out Request Form, or by enabling the Global Privacy Control signal in your browser.

8. Your Privacy Rights Under U.S. State Law

Depending on the state you live in, you may have some or all of the following rights regarding the personal information we hold about you. We extend these rights, in good faith, to all U.S. customers regardless of state of residence, even where not strictly required by your state's law.

Right to Know / Access Ask what personal information we have collected, used, disclosed, and (where applicable) shared about you in the past 12 months.
Right to Delete Ask us to delete personal information we hold about you, subject to exceptions such as completing a transaction, warranty obligations, fraud prevention, and legal/tax recordkeeping requirements.
Right to Correct Ask us to correct inaccurate personal information, such as a misspelled shipping address still on file.
Right to Data Portability Ask for a copy of your personal information in a portable format you can take elsewhere.
Right to Opt Out of Sale/Sharing Direct us to stop any sale or sharing of your personal information, including for targeted/cross-context behavioral advertising.
Right to Limit Sensitive Data Use Direct us to limit use of sensitive personal information to what is necessary to provide the goods or services you requested.
Right to Non-Discrimination We will never deny you goods or services, charge you a different price, or provide a different level of quality because you exercised any privacy right.
Right to Appeal If we deny any part of your request, you may appeal; instructions are included in our written response.

These rights are recognized, in varying form, under the California Consumer Privacy Act as amended by the CPRA, the Virginia Consumer Data Protection Act, the Colorado Privacy Act, the Connecticut Data Privacy Act, the Utah Consumer Privacy Act, and similar laws enacted in other states.

How to exercise these rights: Submit our Privacy Opt-Out Request Form, email us at support@audioimperial.com, or call +1 888-865-1086. We will acknowledge your request within 10 business days and respond substantively within 45 calendar days, extendable once by an additional 45 days for complex requests, with notice to you. We may need to verify your identity before completing Know, Delete, or Correct requests by matching the details you provide against our order records.

An authorized agent may submit a request on your behalf; we may require proof of the agent's authority and may still ask you to verify your identity directly with us.

9. Email & SMS Communications

We send two distinct types of messages, and they are governed differently:

Transactional messages — order confirmations, shipping updates, and support replies — are sent regardless of marketing preferences because they are necessary to complete a transaction you initiated. These cannot be unsubscribed from while you have an active order.

Marketing messages — promotions, new product announcements, and similar emails or text messages — are sent only if you opted in, for example by subscribing at checkout or on our site. Every marketing email includes an unsubscribe link, and you can opt out of marketing SMS at any time by replying STOP to any message we send, in compliance with the CAN-SPAM Act and the Telephone Consumer Protection Act (TCPA). You can also email support@audioimperial.com or call +1 888-865-1086 to be removed from marketing lists.

Unsubscribing from marketing communications does not opt you out of the sale/sharing of personal information for advertising purposes described in Section 7 — those are separate choices, and both can be exercised through the Privacy Opt-Out Request Form.

10. Children's Privacy

Audio Imperial sells consumer audio equipment intended for adult purchasers and is not directed at children. We do not knowingly collect personal information from anyone under the age of 18, and we do not knowingly sell or share the personal information of anyone under the age of 16, consistent with the Children's Online Privacy Protection Act (COPPA) and applicable state law minors' provisions. If we learn that we have inadvertently collected personal information from a child under 13, we will delete it promptly. A parent or guardian who believes their child has provided us with personal information may contact us at support@audioimperial.com to request deletion.

11. How Long We Keep Your Information

We keep personal information only as long as reasonably necessary for the purposes described in this policy, then delete or anonymize it. As general guidance:

  • Order and transaction records are retained for at least 7 years to meet U.S. federal and Florida state tax and accounting recordkeeping requirements.
  • Customer support correspondence is retained for as long as needed to resolve your inquiry and for a reasonable period afterward in case of follow-up or warranty issues.
  • Marketing email and SMS subscriber data is retained until you unsubscribe or request deletion, plus a short period to honor and confirm that request.
  • Cookie and analytics data is retained according to the retention settings of the relevant analytics or advertising platform, typically between 14 and 26 months.

12. How We Protect Your Information

Our checkout is hosted on Shopify's platform and protected with 256-bit SSL/TLS encryption. Payment card data is tokenized by our payment processor and is never stored in full on our own systems. Access to customer information within our business is limited to staff who need it to fulfill orders, process payments, or provide support, and we review our practices periodically to keep them current.

No method of transmission or storage is 100% secure, and we cannot guarantee absolute security. If we become aware of a data breach affecting your personal information, we will notify you and the appropriate authorities as required under applicable state breach-notification laws.

13. Service Area & Data Location

Audio Imperial operates exclusively within the United States and ships only to the 50 U.S. states. We do not fulfill orders to U.S. territories, APO/FPO addresses, or any address outside the United States. The personal information we collect is stored and processed on servers located in the United States, operated by our service providers including Shopify Inc. We do not knowingly transfer personal information outside the United States.

14. Third-Party Links

Our site may link to manufacturer websites (such as Audiolab, Cyrus, Dual Electronics, Mission, Q Acoustics, and Violectric) for product specifications, or to our financing partner's application page. Those sites operate under their own privacy policies, which we encourage you to read. We are not responsible for the privacy practices of any website we do not own or control.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, our service providers, or applicable law. Any changes will be posted on this page with a revised “Last Updated” date at the top. If a change is material, we will provide additional notice, such as a banner on our site or an email to subscribed customers, before the change takes effect. We encourage you to review this page periodically.
